what should i do when the payment is not settle and i dont want to be charged for sales tax.

Ebay tell u up front what they want when you list the item and take it. Apart from that I don't think they take anything without letting you know.

eBay does not sell things and therefore does not charge sales tax. The exception to that would be the eBay fees charged for your listings IF that sort of service is taxable in your state AND if eBay has a nexus in your home state.

Vendors on eBay do have to charge sales tax if required by the vendor's home state. If you are a vendor and a buyer did not settle then there is no sale and you do not collect and render any sales tax.

eBay won't charge you sales tax if you do receive payment. It is the seller's responsibility to collect any sales tax that is due.

If you never get paid, you file an unpaid item dispute with eBay--that will get your final value fee refunded.

Sales tax has nothing to do with this.
