My friend got caught for possessing control substance couple years ago and went on probation and attended classes on drug. Now he got caught again for possessing control substance (speed). What will happend to him? Will he get probation and classes again? Will he go to jail? What are the consequences for pleading guilty vs not guilty? His court date is 2 days from today. He's still in jail right now. I understand he will get a public defender. Someone told me he should plead not guilty and go back to court in one month - problem with that is he will have to go back to jail for one month waiting for trial right?

They found 2 pipe and some open bags maybe worth $15 only of speed.

A lot depends on your state laws, your county prosecutor and the presiding judge. Sometimes the court finds it contemptuous to allow the offender to have a second chance, offer classes etc and just have them come back and do it again. I'd contact the prosecutor's office and see what the options are and what the different levels of consequences are.

He needs to plead not guilty until he can have a pre-trial conference. This will give the prosecutor a chance to offer a plea bargain. If it is acceptable to your friend, then he should plead guilty. Never plead guilty until after the pre trial conference.

I am not sure what your friend is facing. It is another felony so he might serve six months, to one year in the department of corrections. His current time served may go towards it. I wish him good luck, and hope he gets clean.

It depends on your states law. But it sound like a possible probation violation.

Varies based upon what state you are in. Some states have weak drug laws, others are thankfully stronger.

I'm not positive but I believe in some states it can result in the loss of one testicle.
For women I'm not sure.
