Earnhardt wouldn't have been saved by the HANS device because his seat was altered.

In smaller series yes people have been killed in a race car since the HANS, but not the major (truck, Busch or Cup)

Earnhardt's seat belt pulled apart because of improper installation (not following the manufactures installation instructions). The Hans device wouldn't have saved him, it is only designed to hold the head and neck not the whole body.

There's a coroner's report on the death of Dale Earnhardt that reveals that death was caused by blunt force trauma to the head, not faulty or cut seatbelts as urban myth suggests.
The open-faced helmet didn't do him any favors.
Since his passing, there have been no deaths at NASCAR's top 3 levels or racing.
