I don't think that would fly, not if it got to a jury, the US is quickly becoming anti religion, especially after 9/11. Murder is Murder no matter how you look at it.

As clarified in Bob Jones University v. U.S.: “the Free Exercise Clause provides substantial protection for lawful conduct grounded in religious belief, see Wisconsin v. Yoder, supra, at 220; Thomas v. Review Board of Indiana Employment Security Div., 450 U.S. 707 (1981); Sherbert v. Verner, supra, at 402-403”
Given this interpretation, I do not believe so, though it would have given some people pause.
