The sinner of course because he recognized his true condition before a Holy God and he asked for mercy from a spirit of humility. The pharisee was too proud and full of himself to know his true condition before God. He was self righteous and thought all his little works were going to earn brownie points with God.

The sinner because he was aware he sinned and needed forgiveness. He was sincere and made his heart submissive to the will of the Father by asking forgiveness.
