First, if you and your mother need to go to get checked out, do so. Who pays for your damage and injuries? I have no idea. Does he have insurance? Is he a valid driver? Are you in a no-fault state, where you have to collect your medical from your own policy? If so, does your mother have a policy herself?
There are WAY too many variables here. YOu are going to need to talk to your own agent. That's the guy you pay, for this kind of advice.

Go ahead and start the process with the other driver's insurance company. The sooner you start the process, the easier it will be to start tallying the costs.
Get estimates on the physical damage for your car.
Collect all receipts, costs, etc on the medical items that you have incurred. And keep a written record of everything that has happened to you and your mother. Be as detailed as you can be.
Starting the claim does not mean that you cannot add costs to your claim. That doesn't stop until you Settle with the insurance company.
Do not sign anything you do not understand. Do not sign away your rights to money settlement.
You can settle this yourself with the insurance company. However, if you do not feel that you are getting a fair settlement, you can threaten to contact a lawyer and see what they do.
If you hire a lawyer, be prepared to give your lawyer a significant portion of your settlement.

First of all get an accident report from the police department and turn it in to his insurance company. Explain that you and your mother are experiencing back and neck pain and you need a claim number for the medical bills to be filed with. Seek out a doctor or a chiropractor and get treatment. Also take your car in for estimates and submit the highest 3 estimates to his insurance company to determine if they will pay for the repairs (ask for a rental car) or if your car will be considered totalled. If the damages are 60% or more of the blue book value of your car then more than likely they will total it.

Call your insurance AND his. Tell them both exactly what happened and what was said. Get a copy of the police report. Go to the doctor and tell them what happened - it's not too late. Some injuries don't reveal themselves for hours to days after a car accident.
Yes, you may absolutely still get paid for your injuries, both you and your mother need to be thoroughly evaluated by an MD....now.
Do not accept any settlements from the insurance company until you are certain of the extent of your and your mother's injuries.

Ignore the first few answers you got. YOU don't need to get estimates or anything else. The leg work for this will be done by your insurance company. Contact them and ask what to do. They will send someone to look at your car and they will help you to get a rental and needed medical care, and go after the at fault party to get you made whole.

call your agent and let them earn their salary. do not call his insurance, you will only make it worse for your agent. refer any calls from his agent to yours. only talk in the presence of your agent
