According to section 311A CrPC of India,the Magistrate will not pass an order if the person is not arrested at any point of time, but what is the power of police to obtain such handwritings , given voluntarily, in course of investigation? Is it mandatory to arrest the accused person named in the FIR and thereafter obtain his handwriting for their comparison?

handlwriting specimen can be taken by police only in prescence of a magistrate. otherwise these specimen have no legal value. if a polic officer has taken hadwriting specimen from you by threat please contact a lwwer immediately
