It's only a crime if you get caught. Drive safe and don't act the fool and you should have no problems.

If the provisional license does not allow you to drive after 12, then don't. The rule is the rule and there's not all that much "wiggle room" in it.

Depends on the state. In California it's like $50 and ten hours of community service or something.
