I lived in an apartment in Michigan, and relocated to Ilinois. I gave the proper notice, and did everything I was suppose to before leaving. After living in Ilinois for a couple of months, I received a letter from my landlord stating that they have set a court date regarding my eviction. I did not receive this notice of a court date, and they claim I did not show up. They also told me that in order for them not to report it to the credit bureau which would ruin my credit I would have to pay them $4,000. I would like to buy a house in a year, and this would make it almost impossible if an eviction shows up on my credit history. I did nothing wrong, but they think they can get away with this, and I'll pay up. I'm a single parent just getting by, and I can NOT afford a lawyer and all the costs related to this. What can I do to get free from this situation? I'm worried sick...Please Help, thank you...

Beth there is legal -aid out there for people who need help.Do you have all the proof of the proper move out..I hope so good luck

Minimally, go to the local legal aid society. Also, since your landlord said a court date had been set verify this with that court. It sounds like your landlord is committing a fraud upon the court. You may need to have him criminally charged. You do need an attorney. This is very serious. If you can afford a down payment on a house, you can afford an attorney. If you do not go to an attorney and the landlord is trying to blackmail you, you will most likely never get a house because if you do not fight this properly, then you will be presumed delinquint by every bank in the country and no one will touch you. You telling someone it was fraud means nothing unless a court backs you up.

Contact the courts in your old neighborhood and see if it is true. If the letter came from the landlord who knows if it is real. It would take more than two months to get the papers processed and served. It would be a couple more before he got a court date.

Do you have proof of notice to vacate? With this a lender will not care if it is on your credit.

lIf it is an illegal eviction then you shouldnt worry. You did state that you gave proper notice prior to leaving. I dont understand at all the eviction. Were you actually evicted? If so, you need to pay up.

It is my opinion that you can't afford not to have a lawyer. I don't know about Michigan but it would seem to me that you would have to be notified by certified letter.
