My grand father has ancestral property and he has 5 sons and 2 daughters. Can he make a will of ancestral property to everybody or any one he likes. Please reply. If made can any one challenge.

Firstly the grandfather in his sane state and under no coercion can make a will and disburse his property as he pleases. for that it all has to be solely owned by him. Secondly if he fails to make a will his property is to be equally distributed to all his offsprings. in case one or any of his offsprings isnt alive, that share will pass on to the legal heir of the offspring. Once he makes a will and takes adequate precautions his will cannot be contested. Its hence very important to think through while making a will.

If it is ancestral property,he can not leave any WILL. It will automatically go to the leagal heirs. He can not have any hold over that. He can not also distribute as he wishes. If anybody(-Legal Heirs-) goes to the court, he will be legally punished. Nobody will be purchasing the property when you want to sell .

Where is the ancestral property located?

If in the US, he might consider placing the property in some kind of perpetual trust - to keep from having to subdivide it (unless one sibling wants to sell to another sibling).

He needs a lawyer to do this - and I would do this quickly before any of his direct heirs pass away.

If it's in another country, he'll need to abide by the laws of that country.

He can make a will to his family members - not outsiders; if this property is in India. The siblings read grand children (male) have a right to ancetral property. Check with your attorney, in any case.

Ancestral property can not be willed to anybody outside the family, as far as I know but if he has earned it himself, he may give it to anybody he likes.

If he is the sole owner , he can will it to anybody he wishes.
