Got in accident,had no insurance,no one got hurt,thankfully. Got blood tested for alcohol and drugs. They will find both. I'm a first time offender with this. Should I expect any jailtime? Just a little worried. I'm single with child. Live in PA. Any advice?

If you have a decent lawyer, you may get away with a program (I cannot recall its name) for first time offenders, where you'll have to attend classes instead of jail. You will still pay a heavy fine and will have to pay for the classes. But, with no insurance (which is a crime in itself) and both drugs and alcohol, that may be a long shot. And if you're a single parent, you may want to lay off booze and drugs.

That should be good for about 6 months jail time. Should be saying bye bye to your license for about 2 years. You failed to give your alcohol level or the drug. If it's meth, a decent judge would put you in a 4X7 cell for about 5 years. Less for other drugs. Probably no penalty on marijuana. But on driving uninsured it's a shame they don't take your license away forever. The fact no one was injured wasn't for your lack of trying. Another great penalty for driving uninsured is had you injured someone, you should be given the same injuries so you could fully appreciate things. A few years laying in bed as a quadraplegic would make you think differently. First time offender? Don't make me laugh. You must have done the same many times. The only "First Time" is this time you got caught.

Jyame, I think you may get jail time,i am not sure,but yes I do have advice for you .Seek help from AA organization or Narcotics anonymous. You should get down on your knees and thank God that he spared the lives he did and that no one was taken or hurt. you should not only worry ,you should take the images of that accident and pound them into your memory so you do not ever forget. You say you have a child, for the child's safety and yours seek the help you need and do not be concerned about jail. Maybe being your first time if you do have a seriuos drug and alcohol problem and want help , let the judge know your intentions and be honest with the judge and yourself. I am usually a nice person on this site,but some times you have to use tough love to help people.
pray to God and thank him. maybe he is telling you ,you have a second chance,use it wisely.

well people have some pretty strong opinions don't they? i would try and locate a lawyer that gives free consultations. free legal help.com maybe? then give him the skinny, and see what he says. with the way drivers licenses are fingerprinted and bar coded you can't run, unless you leave the country., and still drive. so ...face up to the music. no matter what, the system is set up so they win. they want money more than anything. if what they wanted was to stop it, they would put BAL testers on cars like they have done with DVD players and GPS systems. don't you think? they busted me with a BAL of .04 , first offense, and after $5000 and hours of community service and hours of classes the most important thing i learned was this ...if you do it, eventually they will catch you. so the only way for you to win is to never do it again.

The drugs will probably never be detected.

Due to the costs of conducting the tests, the drug tests are normally cancelled if the alcohol tests above the legal limit. This is .08 in PA.

Why are you driving drunk and on drugs with no insurance when you have a child to care for?
I doubt that you are a first time offender. this is just the first time that you got caught.
I hope you do get locked up for a long time and your child goes to some one who is responsible.

If you are not already in jail, you will probably not get jail time. You may have your license suspended. You may also have to do community service and you may have to explain to the court (if your child is a minor) how they can be sure that you are a fit parent, and will not endanger your child by alcohol and drug use.

Leave the state immediately. Apply for a drivers license in your new state immediately. Never go back to PA.
