Hi, Can anyone tell me if there is a legal minimum number of days holiday that an Australia company has to contracturally give you (not including the national holidays), or is it just down to the company to decide how many days it allows?

I don't know about it under our new Industrial Relations (IR) Laws, but it's always been, a minimum of 4 weeks annual leave.

4 weeks of annual leave was one of the few things that was preserved under the new work place laws. However, I think they also provide the "flexibility" to negotiate to give up some of that leave in return for more pay. Any such arrangement would be subject to a fairness test, but I have no idea how much pressure an employer can legally put on an employee to accept reduced leave time.

In short, you should expect to receive 4 weeks leave per year.

The Award is four weeks a year. If you work ten or more Sundays in a year you get another week. This was the case until WorkChoices. Now anything goes and you can lose most of your paid holidays at the whim of your employer. As WorkChoices will cease in just over a week, we will be back to four weeks paid annual leave - as it should be.

check with the labour board but its always been at least 4 weeks per year
