hi you partner can adopt but the way it works is that you also have to go through the adoption to, mad as it sounds i tried this with my son and now husband but the adoption service said that i had to adopt him too, so i just changed his name by depoll, also you might want to be carefuk because if he doesnt know any thing about your partner not being his dad, the adoption service will want to talk to your son, about all thats happening so that is another reason we didnt because it would mess up my soins head too much

Your son's biological father would have to petition the court to relinquish his parental rights, then your partner would petition the court to adopt your son. The judge in each case has the authority to grant or deny the petition. The first step would be to retain an attorney who specializes in Family Law.

I think the only way he can is if the father gives up the right to the child. I don't know why you'd do that but I guess it's up to you. How does your son feel? I wouldn't let anyone adopt my child. If there is a break up he will have every right to take the child from you. I wouldn't do that, but I am pretty protective [paranoid] about my son.

Yes he can but you have to make sure the bio father either knows so that he can give up his rights and allow your partner to adopt. However, if the bio father has no legal rights to your child then it should be much easier to let your partner adopt your son. I would contact either legal aid or a lawyer about this.

do you know where the biological father is, have you put effort in to try and find him. If you can contact him, then ask him to sign over his rights, if he does then your husband can adopt him, if he dosnt want to sign over his rights, then just say ok, im filing for maintenace and you will have 6 years of back pay to make up for and possibly lose everything you have aswell as continue to pay for the next 12 years. He may opt to sign over his rights.

I was adopted by my step dad when i was 7. My real father was in prison at the time and the only dad i had was my step father. that all went through just fine. there are stipulations. i would just call a lawyer and ask. it varies from state to state.

it depends. does his biological father pay child support? if he is not involved at all you can file abandonment, usually if he's not been involved for at least 3 years. if the judge grants it he can be adopted, but i think you may have to be married, depends on your state.
