Imagine if some members of Al Qaeda captured you and threw you in a cave in Afghanistan. Would you not, as a prisoner, expect to be tried for your crimes? They have no concept of rights of a prisoner, their home country does not give them those rights. They don't know what it means to have a right to a lawyer and a fair trial.
The problem with the detainees is usually the evidence is so flimsy it won't support a conviction, and at the same time these men might be dangerous. I say might, because many might also have no desire to be terrorists whatsoever. It would be kinda foolish to let someone off because you didn't have enough evidence that someone intended to commit an act of terrorism, and then have that person go out and plan a terror attack.
That's really the problem: imagine how hard it is to find evidence that an individual plans to commit an act of terrorism, and prevent it before it happens.

Europeon, you spend a lot of time here talking about how terrible the things the US is doing or has done, have you done any research, it would not be difficult to do, to find out why those people were put there to begin with? i dont think it was because they bought alcohol underage or were doing 5 mile over the speed limit. by the way, did you forget about 9/11. there are reasons for detaining and questioning these prisoners, and yes, it is taking time to find other places to put them for detention, they are not all being released, stop ranting.

It is terrible .............. you are innocent until proven guilty. In south Africa during the Apartheids Years, innocent people were detained without a trial for 90 days ................The World including America regarded us with outmost distaste which was right. But to detain people for 6 years without a trial shows you what f... up Legal system the USA has. Where are the Human Right activists! These people must ALL be innocent because why have they not been tried yet? If the americans had a case against them surely they would have been tried? are they going to wait for them to die of old age/ Is it because these men have been tortured .... against the Geneva convention and the USA is scared the attrocities that they have committed against these prisoners will come to light. If they are guilty, FIND THEM GUILTY AND PUNISH THEM, but do not let them rot as innocent men for years. I think it is time to release them ................. technically they are still ALL INNOCENT. They have families and children. My goodness when is some one going to bring them infront of a court and let justice prevail?

People who use that argument that they were captured on a battlefield without a uniform and therefore have no rights should realize that many times special forces operate in civilian attire and that same argument applies to them.
Remember that when US special forces get captured in Iran.
To answer the question, trials should have been held long ago.

Absolutely not!!! War or no war.....they are terrorists and this is a war for the long haul-they'll be there for a very, very long time and under the Geneva Convention, that's where they'll stay and rightfully so.
