the cse lady tried to tell the judge i wnt my money back and she think i should not get it back. the judge said i have a right to petition the court for my money back.so who do i sue the agent or the mother. first of all this started in 1995 i was served at a address where i had not live in 3 yrs. so i didn't get the papers. then when i called the agency they told me they would give me a test but they never did. so i had to fight for the right to get one.so if the judge said i have the right to get my money back then who do i sue. she knew this was not my child and she and i both know who the father is can i sue him.he didn't have a job back then so she lied on me and she knew i didn't live at that address when she had them to send thoses papers there. and since we got the test in feb 2007 she said if any money came on the card she would send me back my money well she never did so she is in the fraud and child support people are to because when they saw the test they should have stop

Sue the mother. You may be able go after the mother and the agent for fraud. Talk to the local police/prosecuter about lying to the court. Get real legal advice.

The this is u have to sue the mother that stated that u r the father and in NYC when u go before the judge for child support they askif u want a DNA test if u say yes the case is on hold untill the result is in if u say nou dont want a DNA test then they take it that u r the father and also if there was a default judgement and u prove that u were not the father then the mother ow u all the back money, once u found out about the child support and meet with the judge u should ask for a dna test if u did not then what does that make u ?Bro as i said it's all on u if a child is not yours a judge cant force u to make support payments trust me I know i went to court for the same thing.

Bro, I think I have heard of a case like this and the court is not going to make her pay you back. I hope I am wrong, but you need to watch how you say things. " I found out my daughter" That could bite you in the ****. I hope you can get it back but you might have to prove she took it under false pretenses. All that said, being a Dad and having a Daughter is not really about DNA. Big difference between being a Dad and being a biological father. I was not there when my step daughter was made, but she is my kiddo and if you ask her, I am her Daddy. That my friend is what matters. I hope you and your daughter keep in touch, good Dads are hard to find.

I know in maryland you are **** out of luck. My best guy friend was in this situation. he payed child support cause it was ordered. social services said he needed to get a test, he didn't and then 4 years later he finds out it wasn't his the judge said that it was his responsiblity to get the test he didn't there for he is at fault. No money due back. Now if you had the test and you still paid you are still at fault for being stupid.

You sue the mother - you will have a MUCH stronger case if the mother always knew it wasnt your child as then you would not only get reimbursement but also compensation.

CAll a lawyer.

But you are probably going to spend as much money trying to get the money back, as the money you are owed.

You could just drop it and move on with your life. The only one getting hurt here is the CHILD.

Call a lawyer and sue the *****. She knew exactly what she was doing. Too many woman are getting away w/ this bs in this country.

I think the true father will be required to pay back support....mandate that when he pays it comes to you. She sounds like the type (the mother) that probably doesn't have any money....this is bad huh.
