If a divorce is in the works, can the alias that is used at the workplace be changed? On all the papers there, I'm listed with my married last name. I want that changed to my maiden. Will this affect anything regarding taxes and whatnot? I claimed 0 on my taxes and am marked as "single." We filed jointly last year for taxes, but we were given the option to file separately.

I was thinking it wouldn't be a big deal since my social security number would show each name, and since I didn't mark 1 for taxes. Help?

A woman has the right to change back to her maiden name at any time . Her maiden name is her LEGAL name.

All you have to do is get copies of birth, and marriage or divorce certficates, and take them to the bank etc to swap your name back.

What you claim for withholding doesn't have anything to do with you income tax filing status. It has to do with how much money is withheld from your wages to offset your year end tax liability. If you are legally married on 12/31 you generally file married filing jointly or married filing separately (if there are kids involved then how long you lived apart may be a factor, but you should discuss that with your tax professional). Married filing separately is the highest tax rate, with the least deductions/credits. You file your tax return using your name on your social security card.

Your legal name may well be your married name - if you use your married name you will need to request you be restored to your maiden name in your petition, then change everything through your work. Otherwise you have to do a separate filing with fees, etc. Your divorce attorney can explain all of this to you.

You social will not show each name. It will show your legal name. If you went to the SSA and changed your name to your married name after you wed then that is considered your legal name. If you never had it changed at the SSA then your maiden name is your legal name. Whatever is on your most current social security card. Just deciding to go by your maiden name will not suffice.You will have to take your final divorce decree(yes you will have to ask for your maiden name back in the divorce)back to the SSA & apply for a name change and a new card, then and only then can you go by your maiden name if you had your name changed to your husband's legally. (wow, what a run on sentence...LOL)Since you guys are not legally divorced I am not so sire than you can file seperately unless you file married filing seperately which is a higher tax bracket.

You will need to advise the judge in your divorce of your intent to go back to your maiden name. Once the order is granted you will need to apply for a name change on your drivers license and social security card. They will ask for a copy of the court order. You will need to change it on your social security card before you can change your banking info and work info.
Simply file your income tax using your maiden name. If you haven't changed your name or the name on your social security card by tax time you'll have to use your married name. It isn't a big deal, just a bit of a pain.

Why are you using an 'alias' at a workplace? Every place I've ever worked has required that I use my legal name (and I can't imagine that a company wouldn't require that). If you changed your name when you got married, then that’s your legal name until it’s legally changed again.
