Yes I know this story all too well. My problem was that my man has always paid support since we have been together. Last year his ex moved from one state to another and went to the support enforcement and told them that she didn't receive support at all, no current court order and that he refused. she also stated that her new bf paid the support that my man did. All was a lie, there was a order set in 2002 before he left the state due to her craziest. And then without any knowledge my husband was served with papers with a statement from her stating that he hasn't provided any support and he neglects his child. I have all receipts of payment backing until 1998. He went to court without an attorney, they slapped him with 10000.00 arrearage, 115.00 a week support payment, tripled from the orginial order that was set in 2002. The states attorney did not want to discuss anything with him. We had to file new papers, hire an attorney in our state and one in the other state to get the copies of the orginial order and go back to provide that she lied and that he had been paying and their was a court order. They did side with us and drop the 10000.00 and now we have to pay the attorney finish the divorce proceedings because she said that she filed the divorce in the orginial state and they were divorced and come to find out that was a lie, when he called to get those copies, they said she had dropped the divorce. I think she wants her cake and eat it too. So he called her to make an agreement on the divorce and the support and she said that she didn't want less then the 115.00 a week because she doesn't need to work if she gets that. So now my husband is support his kid and her other kid and we are broke. We were planning on our first baby this year but we have decided not to again. I have been waiting for 5 years to have a baby and each year this woman pulls something out of her hat.

This is what DNA is good for.

Prove this married guy is the father .. by DNA .. then he will be liable for child support.

The Courts do not distinguish between married .. and unmarried .. real daddy's of babies.

The Courts are interested in the welfare of the child.

You can also force him legally to have his DNA tested.

nope. the child support office will treat this as child that needs support. regardless if it came from an affair. and..because he is married, his wife's income will be looked at since she isn't collecting support from him, she might after she decides to divorce him though.

It is the same. Is he listed as the father? If not you will have to get a paternity test unless he willing agrees to pay it. Being married changes nothing, he is still responsible for any children that he fathers.

If he denies it, the court will make him get a paternity test. When it proves positive, he will be ordered to pay child support.

If a paternity test proves him the father, he still has to pay, whether he's married or not.

You shouldn't have slept w/ him. His legitmate children should take priority. You need to get a damn job and support the kid too.
