Well my brother's girlfriend got pregnant with his baby. Then they split up a few months ago. She left the state and had the baby without telling him. He called her home and was told that she left the state and had the baby a week ago. Is it legal for her to leave the state and to keep my brother from seeing the baby? What rights does he have?

He has paternal rights, providing he didn't give them up. But there's no law saying that the mother can't leave the state.

I would suggest that your brother seek legal aid to find out his rights in this case.

If she left the State BEFORE she had the baby, then it's perfectly legal.

She can't keep him from seeing the child, though. He can petition the court where she now lives for visitation rights. (which will, of course, also impose a child support obligation on him)

Actually in some states there are laws regarding how far the mother can take the children, even if she has primary custody.

This is a custody dispute in the making for sure. He should contact an attorney.

First I would check to see if the baby is his.

if there we married it would be illegal but if there arent married u probably have to go to court if u want to see the baby

If they were married no it was not legal. If they wern't married it could get messy and they might have to go to court.
