My husband was sent to jail for violation of probation. He was sentenced to 6 months but he will serve 4. Now we would be ok with it if I wasn't 7 1/2 months pregnant. We are not to firmilar with the laws and stuff. Is there any way of getting him out early or as soon as we can. He was the only form of income and we were living at his mom's and now there is no income and his mom said I can't stay with her if he isn't here too. He was put into jail November 8th (thursday). I dont know if there is any ways but if you have any ideas I would love to hear them and see what we can do. If there is a detail I did not put in and you would like to know please let me know and I will add it for you. Thank you.

I will be fine but I do want to know legal advise. So please do not answer if you do not have information for me. I just need to know facts.

Sounds to me like you need to contact social services for emergency shelter, and possibly welfare because the baby is coming soon.

Your husband broke the law - he is going to jail. I'm sorry, but that is just reality. You could be in active labor on a street corner and that would not make them let him out early.

Contact a woman's shelter to help you -- now. you and the baby need someone to help you out since obvioulsy your man didn't give two poots less whether you were taken care of or not!

Unfortunately, the fact is he's unlikely to get out early. He can ask for a hardship release, but you should expect it will be declined.

The problem is that he's gone in on a probation revocation. That means he broke the law and the judge gave him a break by letting him out on probation instead of keeping him in jail. In return, he promised to keep his nose clean while he was out. Instead, he broke the law again, and is therefore returned to prison.

When you've broken the law, the courts will often give you a break. If they do so and you just go ahead and break the law again, judges tend to take the position that if leniency didn't teach you a lesson, maybe strictness will, and throw the book at you.

Sorry to be the bearer of bad news.

Apply to the state for a hardship release. Contact his probation officer also and see if they will assist you in anyway. Also contact Social Services for emergency relief assistance for you and your child.
Bless you and your family. You will be in my prayers.
Good Luck

I feel so sorry for you and your baby, all alone at christmas. Is there no Social Workers in the States that can help you with a place to live?
