It will go to trial. Probably early next year. He has two problems. One is the audio tape which purports to having him yell that no one is leaving the room. That's verbal admission of attempt to kidnap under Nevada law. That's life without parole.
The other problem is the presence of the firearms at the crime scene. Under Nevada law, the use of a deadly weapon in commission of a crime automatically doubles the sentence. And it puts the convicted person in a position where he has to serve at least 70% of his adjudged sentence before the first parole hearing.
This isn't the "Peoples Republic of California". This is the old West.
