The copyright in a photograph (unless it was taken under a contract that said something different) belongs to the photographer, NOT to the person in the photograph.

But, using a persons image in advertising, for example, can require them to be recompenssed as a model.

However, if YOU took a photo of, say, Jimi Hendrix, then you can put that photo on a tee-shirt and sell it perfectly legally. (That, after all, is what paparazzi do when they take a picture of Britney with her legs open and no panties and sell it to the Enquirer)

If you didn't take the photo, then you'll need to pay the photographer for the rights to use it. If you do a Google for "Persons Name" and "Stock photo" you'll find any number of photo agencies that have pictures of every celebrity under the sun available for licensing.

Look around for empty bottles of whatever I may have been drinking the night before. But there aren't any, so I poke this person to make sure they are really there. And when they grumble at me I lay back down, snuggle close, and go back to sleep. Ahhh...happy day.
