The landlord must first give the tenant the opportunity to correct the violation. Normally the landlord sends a 30 day "Notice to Cure or Quit." That gives them 30 days to do one of the following:

1. Advise the landlord of the name of the occupant (and get their signature on a lease addendum if the landlord wishes.)
2. Have the unauthorized occupant move out.
3. Move out of the premises entirely.

If the tenant fails to act, the landlord then files a formal eviction suit in the local courts. The process can take 45 - 60 days or more. (Evictions for non-payment are faster, typically 20 - 45 days, but evictions where the rent is being paid and the property is not being destroyed take quite a bit longer.)

You can type a formal notarized letter informing him or her how long they have to live by the terms on the lease then you can visit your local court house to file for an eviction and i think if you pay a fee they can serve the tenant. Good Luck!

Eviction is different in each state. A first step in most states is to notify the person renting that they violated the lease by having someone else move in unless it is someone they married of their children.
