Or is it a guideline? Or does it only apply to subsidized housing, or apartment complexes? If a family of four stays in one hotel room or efficiency, besides being cramped, is it illegal?

Some communities limit occupancy based upon the bedroom count or square footage or both. There is no limitation in state law. Landlords are free to restrict the number of occupants as long as they do so consistently and do not violate the Fair Housing Act in the process.

A landlord is allowed to restrict the occupancy of their rental unit as long as they always do it (not just to keep you from renting but always) and as long as they are being "reasonable". Reasonable is defined by HUD as two per bedroom.
