I went to india and met someone that I like, and we did not have time for engagement, but we want to go ahead now. Is there a way that if I file for her as a fiance visa from USA, then she can go to indian embassy or wherever she has to go, and then get the visa, then I can come back to india after the 4-6 months, and then we can have the engagement and marriage and then she can come back with me right away. I am a US citizen.

Hi Sarah, thanks for the response, but I could not email you as you turned it off, did you and your husband get married in india, like socially, meaning do the mandap and pooja's and all that stuff? then after that, he applied for a visitor visa?

You are confusing the whole issue unnecessarily. In your last question I told you regarding your valid Indian marriage & bringing your wife on the basis of K-3 visa from India, this is the easiest & best way to bring her along with you after marriage on the basis of this K-3 visa (non-immigrant) in the meantime the immigration petition filled by her on the basis of her marriage to you will be under consideration & decided while she stays with you in USA. As far bring her on the basis of K-1 fiancé visa is concerned there are lots of formalities required in this. This K-1 visa is issued by the U.S Consulate to the fiancé of a United States citizen. It is a temporary visa that requires the foreign fiancé to contract marriage with the U.S citizen within 90 days of entry into the United
States. The U.S citizen is required to file a permanent resident petition as well as a temporary residence petition. On the approval of the temporary petition, the foreign fiancé must then file an application for a K-1 Visa.

The couple must provide evidence that they have physically met within the last two years, unless religious principles prevent them from meeting each other before the wedding. There is no limit to the type of proof that can be submitted for this purpose. Letters, emails, phone bills and pictures of the couple together are forms of evidence that can be used to substantiate the petition for a K-1 visa.

The U.S citizen must establish that he is a United States citizen and the couple must prove that they are free to marry.

Upon entry into the U.S the beneficiary must marry the U.S citizen within 90 days and thereafter must adjust his status to acquire permanent residence on the basis of his marriage to a U.S citizen. But in case she is brought after on the basis of the valid marriage certificate on K-3 visa the other formalities as stated above in K-1 visa will not be required, she enters as your wife & her permanent residence/immigration is decided while she stays with you in USA.

to be honest a finace visa isnt requird. So that my husband and I could get married quicker he came over on a visitor visa, and then after the wedding you file three forms. a work permit application, another form so that US recognizes the marriage and then the important one is the adjustment of status

My husband is from england however if you are a us citizen or a perminate resident bringing a spouse over would work the same way for you. Once your married you just file the three forms and they cannot deport your spouse while the process the paper work barring a crime your spouse is considered under a protected status. You must be a nut case to marry an Indian Lady or even take her to the US - with no commitment!!
