I was involved in an auto accident, where I was completely stopped and the driver ran in to me. I have a Tacoma truck and the driver that hit me had a 2006 mustang. The driver had no damage to their front bumper, but I have a huge dent in my bumper. I tried explaining that to All-State that I was moving and based on physics my car is going to absorb all the damage and the strongest part of her bumper hit the weakest part of mine. Plus she was cited for careless driving and running in to the back of me, plus the officer who took down the information wrote how much damage she caused o n the police report. So 2 weeks have gone by and they took measurements and said my bumper was way higher than hers and no damaged could have been caused by her car, even though I looked at another mustang like hers in the parking lot and it is the same exact height as mine. I think All-State is a bunch of crooks and bs'ing me. Is my only choice to get my auto insurance to sue their auto insurance?

More like Snake Farm...
I just went through this with State Farm not wanting to pay for their idiot customer hitting me. I'm with All-State also, so get them involved in every detail and keep every bit of information that you receive. DO NOT cash your depreciated value check until everything is fixed and settled. Also demand that Snake Farm pay for the repairs directly with the Repair Shop that you use. They sent me a $3,000 check for depreciated value and to pay for the repairs. The repairs cost $6,600. If I had cashed that check they would have said that I accepted the amount. I would have had to pay the balance out of my pocket. I also recommend having a Toyota Dealer/Repair fix the damage. All repairs are guaranteed until you sell the truck. It will also cost Snake Farm more money to go name brand! Thats what I did, all OEM parts from a VW Collission Center! Every replaced part on my car is brand-spanking new, nothing repaired, all replaced.

Are you talking about State Farm or All State? The heading says SF, but the details say All State. Either way, if she rear ended a Tacoma with a Mustang, I would think her front end would go under your bumper. Was there prior damage that you are trying to blame on her? Police reports don't mean too much as they didn't witness the accident and they certainly didn't see your car before the accident to know if there was damage or not, so that one isn't going to help you.

Since insurance companys are a business, they profit from not having to pay out on claims. First, you should see if you can escalate your case. I also recommend parking your car next to one like the one that hit you, and take several pictures, so you'll have evidence. If you file the claim with your insurance, they'll go after them for you, and this might be your easiest choice. Otherwise, you may have to sue.

Depending on how much the damage was, you may either sue her in small claims court or turn the matter over to your insurance company and sue her for your deductible.

Talk to your company.

You pay them to deal with things like this and they know all the laws that factor in. Besides, they can afford a better attorney than you if its needed.

I think so. Get your insurance involved ASAP, if they are not already. They will fight it for you (so they don't have to pay)
