The first thing you should do is contact a divorce attorney in your area. He or she will be able to take care of the paperwork you need to complete the divorce.
Texas is a "non-fault" divorce state. To obtain a divorce, you must simply show the marriage is "insupportable". You may do this by simply showing that you do not get along and do not want to be married. It is no longer necessary to prove either party did something wrong, or explain why you cannot remain married.
You or your spouse must live in Texas for at least six months immediately before filing for divorce. You must be a resident of the county in which you file for divorce for at least ninety days before filing the petition.

Hmm... A divorce. Hopefully you've tried everything to save the marriage. Well if you're pressed for money you could get this new type of divorce that has been approved for the past 8-10 years. It's a decree signed by you and she that say you have decided not to as man and wife anymore. You can ask an attorney about it, You can call legal aide, and also in Texas there's a group that assist with that called "WE THE PEOPLE" they're listed. I don't think you really want a divorce. The Green sheet is loaded with attorneys and their fees for filing for divorce. The Thrifty Nickel also has a list of attorneys.

well I am in the same situation as you. Go to the court house for the papers. If there is a chance it will be a real bloody battle get an attorney but if its not going to be bad donst sweat it. I was told by an attorney up here not to get one first because it would make it seem like I was the one wanting it all over with and i would get killed by the state laws and what not. It is not very fun But good luck to you man

If you both agree to the divorce you don't need a lawyer. You need an uncontested divorce packet. Not sure if Texas civil court gives you one, some courts such as NY do, free. If you cant get one there you may need someone to type one up for you for a fee, mostly a paralegal can do that for you. Once you get the divorce packet, everything you need to do is included.

first you both need to separate. live in different addresses. than go to your county courthouse and file the necessary papers and have her served than a year later assuming that you both dont have sex you will go before a judge take a friend who can atest to the fact that you both have been separated for a year without having sex and than its done. you are no longer married. if there is any assests than you will have to consult with a lawyer. if you don't have lots of things to fight over and you agree about everything you can go to your court house and get the forms to fill out. it might cost 75.00 or so.. if you do have kids and property thats you cant agree on then you will need to see a lawyer and go that route. good luck
