A 69 year old male is charged with sexual assault and sexual interference with a minor (12 year ld child). He's under house arrest. He can't leave the house without a surety. Can he leave the country with a surety? The conditions didn't specify that he can't leave the country. If he can, how can I change the conditions so he can't. He's leaving the country with a surety on Nov. 19, 2007 and coming back on Dec. 6. but I don't think he's coming back. Please someone advise me of how I can go about stopping htis PEDOPHILE from leaving the country. Thank-you.

contact his probation officer and let them know your concerns. you can even file an injunction with the court as well. i dont see how he is able to leave the country. probation specifically mandates that you cannot have a passport and that you must surrender it in order to have the privilege to be on probation. somethg doesnt sound right. he is either trying to pull your leg- or whomever told you he is going, or he never surrendered his passport which could land him in prison. it is a probation violation.

Depends ENTIRELY on the language of the house arrest order.

Speak to the DA that is prosecuting him. I doubt VERY much he'll be allowed out of the country.

The other option is through his bail. If he's on house arrest pending trial he's probably on bail. If his bail is through a Bail Bondsman, talk to the Bondsman - if the accused skips the country the bondsman is on the hook for the whole bail, so if he suspects the guy is a flight risk he'll jerk the bond in a heartbeat.

possumble..... if you "left the country to go to Disneyland", then you weren't in the US, because Disney is IN the US. The probabtion laws that applied to you are not, therefore, those of the USA.

to the guy who said you must surrender your passport when on probation.....not true. I have been on some form of probation, conditional sentence, or suspended sentence since oct. 2001, and i've not only never had to surrender my passport, i was able to leave the country to go to Disneyland.

NO. If you suspect an attempt, call the criminal district attorney (who works for your state).
