I think people who said trademarking is correct. I went to us copyright dept website they didn't say anything about business names.

Trademark it (uspto.gov) and buy the URL asap. Other companies can use the same name, but not in the same industry (the test is "consumer confusion", so I can start McDonalds Plumbing, but not McDonalds Pizza).
