I really need help with this , hopefully someone can help me!!
If my son's father "who doesn't live with us" earns 2,400 a month, what could be the monthly payment for child support?? I want to tell my social worker that he gives me just enough for her not to force him into child support.

I don't want him to be in child support for personnal reasons. What is the minimum child support payment a father can make in CALIFORNIA without being forced into childsupport.

for CALIFORNIA can someone other than the mother "social worker for example" force a father to be in child support if the mother does not agree, if so, what would they base it on?

It depends on each state and the amount he makes. Do you need more money for the kid or do you WANT more money?

1) How is Child Support determined?
In 1984 the California Legislature enacted the Agnos Minimum Child Support Standards Act. This law established minimum levels of child support and required the courts to establish guidelines for awards of child support above the statutory minimums. This is known as the Child Support Guideline, which was recently amended, effective July 1, 1992.

To calculate the minimum amount of child support to be paid by a parent, the law directs the judge to first add up the total net monthly incomes of both parents. Then, the judge has to compute the percentage of that income that is being earned by the non- custodial parent. Then that percentage is multiplied by the applicable level of welfare payments for the number of children in the household. The result of this calculation is the minimum child support. It should be understood that in the vast majority of cases, the court orders child support above the minimum level, as determined by local support guidelines.

The vast majority of child support is paid under the Child Support Guideline. The guideline is based on a complicated mathematical formula. In fact, computer programs must be used to calculate child support under the guideline.

Child support depends on more than just his income. It depends on your rent/mortgage, utilities paid out, medical insurance. Generally it is based on a yearly wage. His rent and expenses is NOT taken into consideration. The court will not care if they take enough from him to make him homeless. Remember that. Been there done that. I would say judging from what we had to pay out....with his income monthly about $400.00 month for child support for one child. That all depends on the other factors too. If you can keep this friendly between you and him and out of the courts, you will all be much happier. But, he has to be on time with the payments. And you can't be greedy. You will have to work as well, to stay above board.
