The other night a couple of my co-workers and I discovered our boss installed a webcam without any of our knowledge. I am trying to find out if that is legal or not.

if your boss owns the computer, sure it is.

It is legal, because the company owns the property and the equipment. It considered to be the same thing as a convenient store installing security cameras - sometimes is it done just as much to watch the workers as it is for security.

If he has installed webcams, I wouldn't be surprised if he also installed a monitoring program on your computer to track/record what you are doing. They are inexpensive and easy to install without you detecting them.

As long as it wasn't in the toilet or some other place where you have an expectation of privacy he has no restrictions that I have heard of.

Bosses have a lot of freedom to do what they think will protect their company and to keep "bad" situations from occurring on the company property. If he wanted to record every keystroke you made on your computer to see if you are the guy surfing porn sites any court would say that is legal also.

If you are really talking about a web cam, then it depends on whether it is viewable only from the company Intranet.

If it is viewable from the Internet you can probably sue your boss & company for invasion of privacy. You would have to make the case you were somehow damaged.

If it's intranet, it's the same rules as for any other workplace monitoring.

It's absolutely legal. This is a workplace. And it is quite common. Be careful what you do at work. They cannot, however, be installed in restrooms. And they are most generally positioned over stations that are handling cash or the entrances.

But they could be anywhere.

Peace.

Yes, it is legal.
Just like any business that puts in security cameras to spy on the workforce... claiming it's for their own projection...

Now, what he does with the webcam... and what he does with the recordings of the work place... that's another matter.

Yes its legal. The employer can do anything they need to do to make sure you aren't wasting company time/assets (ie: webcams, read your emails, search your locker/desk). If you don't like it, you can find another employer, but more and more are doing this these days.

It is OK for your boss to put the camera without legal permission, HOWEVER, he cannot use that to fire you or something similar. For more information see the link below:

By the Way, If your boss had VOICE recording with camera.. IT IS ILLEGAL... LAWSUIT THAT FU*KER.

THESE MORONS HAVE NOTHING BETTER TO DO, GEEZ..EMPLOYEES ARE HUMANS, NOT SLAVES, AND SOME ASSH*LES DON'T REALIZE THAT.

I wouldn't think it is. I would call my local Government and ask though. Where exactly is this cam? Like in the bathrooms, or what? That may make a difference as to the answer you get also.

Check out the labor laws for Mass. But, I suspect it is legal. Just like tracking your computer and telephone usage. His time, his money, his way. Sorry you work for a place like that.
