The Supreme Court hears a wide variety of appellate cases subject to the Exception Clause and some limitations set by Congress.
2. Marshall gave multiple opinions concerning judicial review concerning both limitations of Congress and limitations of State Courts. If you speak of Madison v. Marbury, he might have favored either party on different points but it is a hypothetical question.
3. Checks and balances brought by judicial review have benefited the country. However, the activist courts have often pushed the limits of creating their own legislation. If we ever had an impeachment of a Supreme Court justice we might test the limits of the Court.
