I don't know about prosecuted, but definitely confined to a facility where drugs are not available until she delivers. Of course she will probably just get pregnant again very soon and continue to use, but not too much can be done there, either. When you get into talking about the reproductive rights of humans, you are in sticky territory! You can keep unfit pet owners from adopting an animal, but you cannot keep people who are unfit parents from having children and abusing or neglecting them -- starting from conception! It's just the ugly side of society and I honestly don't think there are any acceptable answers within a democracy. You can forcibly sterilize dogs and cats "for their own good and for the good of the unborn puppies and kittens" but you can't do the same to humans, even if they are more unfit parents than animals. It is an absolute tragedy to see a child who is handicapped due to in-utero drug use, but putting the mother into an already-crowded criminal system is probably not the answer, either. Very good question, though.

They are so the question is moot. And rightly so judging from the responces so far. Anywho, to give you some perspective on the question. Last week I worked the NIC unit (Neonatal Intensive Care). There was an infant born to a heroine abuser who claimed it was her methadone from the clinic... Hardly! This infant was nine ounces!!!! Put nine ounces in the palm of your hand to see how small that is! She looked about the size of a mouse trapped dead! Her hands and feet were BLACK and were going to be amputated once her blood pressure stablized at 30 mm Systolic.... amazing! And here's the kicker... They NEVER have health insurance which a case like this runs into hundreds of thousands of dollars if the infant dies, millions if she lives... I realize we can not put a dollar value on human life but the soldiers' families of the USS Cole received $25,000... Now something seems askewed to me.
So what do you think my answer is to this question?

I think so but how can you prosecute someone that endangers and unborn child with drug use yet millions of unborn babies are aborted everyday with no prosecution for their murder? Just a thought.

IDK my bio mom was doing drugs when she was pregnant with me. Of course I was taken away from her and never went back, I'd say that is punishment right there. Living your life knowing you couldn't take care of your kid, I think that would be punishment enough! Unless they do it again and then yeah, they should. My bio mom did it multiple times and she went to jail, not for drug use....for stealing.
