Yes a company can layoff salaried and take on hourly employees and there is no recourse.

I work for company that is something like that. In my position with the company there are two pay types, Salary and Hourly, both pay the same. Hourly gets a lower rate, but it's factored in with 10 hours at time and a half. (so to get your full rate of pay you would have to work 50hrs) Salary is just based at 40hrs at a hirer rate. Alot of companies are getting away with salaried employees and even came out within the last few years, with a minimum rate for salary employees ($425 per week)ish. Why I'm not exactly sure. I was told sometime this year that I would be moved to hourly but at no lose of money. I will lose money if I'm not working up to my 50hrs .

There has been an effort to change accounting and scheduling methods for close to 20 years to cut down on the need for "nonproductive" employees. Salaried are considered nonproductive in a factory setting. Many jobs have been eliminated over the years. Salaried people around here are terminated with the elimination of their job. It has litte or nothing to do with job performance. If you're in the wrong job at the wrong time, you're done. It isn't any different than the manufacturing jobs that are now done with technology instead of manpower.

Remember when you walked into any store and you were greeted by some helpful assistant, asking if they may help you find what you need, or how this is better than that. Then came progress... Find it on aisle 35-d...that's not my department...I' ll call someone to help you...what's dat's fo...no sabe English...I'll get my manager, and on and on and on. The answer is.... Why pay experienced people their worth when you can pay a moron much less! So to answer your question, YES, you can be screwed any way, any time, any where as long as the bottom dollar is profit for the "top echelons" that do nothing but video games all day long or shop on the Internet with the money they made ... while you were taking care of the customer

unfortunately the employers can hire and/or fire personnel at will. we tried fighting that in court and lost . we went all the way to the highest court in the state and it was a unamimous decision that we had not only lost the argument, but had to pay the employers legal fees in the actions all the way back to the first day of litigation, a bill that was over $500.000. for what its worth, we had the best lawyers that were available in that field, even the law proffessor at the local university law school disagreed with the courts, but it was to no avail, a done deal.

Yes, unless you live in Minnesota. All other states are what is referred to as no-fault employment states. That means your employer can fire you at anytime for any reason. All they are required to do by law is to pay you minimum wage. Even if you had an employment contract they rarely stand up in court.

Yes they can do this and they do it all the time. Seen it done and it is legal........Then the company moved to mexico.

as long as the company isn't violating current labor laws, they can do what they want. in the i work, company they call it "as business needs".
