I am 17 years old in school and works part time, my son is 8 months old and currently lives with me at my mother's house. The father is 24 and lives in another state 8 hours away, he has a history of drug use and had just recently got out of jail right after my son was born for endangerment to a minor or child, (something like that). He wants to be in his son's life and i had told him he could come see his son ANYTIME he wants, but he claims i'm keeping him from his son because i won't let him come take my son out of state to be with him for a week. What I really want to know is: If i bring him to court for sole custody of my child with vistitation rights do u think i will get it OR is there a chance that he could get joint custody?
Any advise or personal experiences with child custody battles?

You need a lawyer. You need to establish an order for custody, visitation and support.

Custody is a serious issue and one that should not be taken lightly. I suggest as opposed to taking the advice of a bunch of stranger with mostly good intentions, you consult a family lawyer.

Since you are only working part time you should be able to obtain free council through a legal aid program. However if that is not an option contact family lawyers in your area to see if the offer a free consultation. Map out all the most pertinent questions you have an obtain some professional guidance.

If I was the judge I would even question visitation. He seems to definitely not be one who should be allowed alone with the son. Do not let someone who just got out of jail for child endangerment get alone around an 8 month old kid, it's just not smart.

IF he is the father, he has the same rights as you do to HIS child. You don't have exclusive rights simply because you have possession.

If you were to file a petition for custody and visitation then the court is obligated to determine those issues on the best interest of the child and that most times means BOTH parents in the child's life.

The issues you spoke of have no bearing on the custody issues.

well, being that he was charged with child endangerment, i seriously doubt he'll get joint custody. i would petition him to court asap and ask for sole custody...and SUPERVISED visitation. i'm not a judge, but your environment sounds alot safer for an infant than his does. i'd get the ball rolling before he does, though.

You can try, but court is expensive. Chances are (if what you say about him is true) once he realizes that he will have to pay child support to have visitation, he will disappear. Please get involved in a church - youth programs are a great way to have your kids in a stable environment.

You need to keep your child safe. Realize that some judges don't factor in drug use or prison time when determining if one is fit to be a parent.

I guess then they should not take kids out of houses where the parents make meth or smoke crack.
