Two choices:

1. Call a lawyer and get the legal experts to handle it.

2. Go to the courts and fill out the papers yourself, this will save the lawyer fees, you will still have to pay the courts their fee however, you may also if your not completely bad terms get your future ex to go with you it will make it easier for the papers if they can be signed by both parties at the same time.

It does depend on the state. Florida actually does not have any statute for "legal separation", in fact it is incredibly easy to get divorced in Florida (which they call "Dissoloution of Marriage" in these parts). All it takes is for one party to swear in court that the marriage is "irretreivably broken"...but I digress. In reality, Legal Separation has a few connotations. You can use it when the parties want to stay married for religious or financial reasons, and some people use it to set the guidelines for dealing with each other while the divorce is pending, especially when there are children or many joint finances involved, and it also leaves the door open for getting back together if this is ever a possibility. That being said, it is NOT a prerequisite for divorce, unless your state says that you must be legally separated for x period of time before they'll grant a divorce. For the best advice on this, contact a family law attorney in your area and ask them, or if you know someone that's been divorced already.

i think theres a legal way to do it in the states but i know in canada, the day u break up and move out is the date of the legal seperation.
