Middle School: A boy walks past the desk of another boy. As the boy walks past, he kicks the desk intentinaly. A part of the desk flips up, knocking out several teeth. The child needs to see a dentist. The cost of the dental visit was over $400.00. Also, the parent of the injured child lost a full days pay.
The child now needs to have the tooth capped prior to braces. That cost yet to be determend.
The child who caused the injury to date has had two or three in-school suspentions.
Who should pay since the inccedent occured during school hours? I would assume all schools reguardless of what state have some form of insurance. Or is it the responsibility of the parents who's child caused the injury?

just like a home owner, the school should have insurance for injuries occuring on school property even if they are cause by another students aggression. The school board should have an insurance or legal rep you can talk to about this. Also demand that a plan be put in place for dealing with the aggressive student. a suspension should happen and maybe assualt charges filed. In this situation I would suggest contacting an attourney. Also repost this question in the legal category. best of luck

I'm not sure i understand the events that led to this question but as i read this and try to make sense of it what you're saying is that the other boy caused an injury to your child. If the other boy caused the injury to your child then that kid's parents are responsible that is "if" he was the one who kicked the desk and caused your child to loose his teeth. Otherwise, if your child kicked the desk that caused the injury to himself then of course his parents are responsible if no one else was involved. Although it is difficult for many parents to have medical insurance schools only provide emergency help and have limited resources.

I couldn't find the reposted question in another section, so I'm answering it here...
The child's medical/dental insurance is the primary insurance carrier. After those numerous claims are settled, it then goes to the school's insurer, who usually will pick up the balance.
The only way to be compensated for loss of wages, etc.. would be to bring the child's parents to court, since you can't sue a minor.
Medical/dental records will be documented, and a narrative will be sent to the insurance companies stating that future treatment will be needed, so when the day comes when the child is ready for more permanent work, the incident report, narrative, and all other documentation will be available.
Make sure you get copies for yourself.

well, may be in the wrong section - but - I really think the kid who caused the problem should be held accountable, and that means his parents too. I had a similar situation happen to me - but it was after school - however the kids' parents paid my Dr. bills. They offered to - this was also about 43 years ago, not sure people still feel the same about being responsible about things. I wish you luck.

the parent of the child who kicked the desk is responsible for all injuries. i feel a police report might should be filed against the bully. he needs a good taste of juvenile hall before he ends up in prison.
