My friend is being charged with underage alcohol possession and Drug possession (under 28 grams) in Fairfax County Virginia. I was smoking with him in the room but was not present when the police had arrived. When I came back to the room I said the bowl (paraphernalia) was in my possession ( I was holding it for a friend). The police told me that I was not getting a court date because I was cooperating and what not, but reminded me that in the state of Virginia they could have. Now my question is, when my friend goes to court and he tells the judge that I was smoking with him and that the bowl was mine, will I get a punishment as well even though I did not have a court date? If so, what are my chances of going to jail? Thank you.

I know for a fact that my name is going to come up because, on the scene, my roommate denied the marijuana was his and said he didn't know where it came from. So basically he lied to the officers, and now he is going to change his story and say that it was indeed his and that we had been smoking it that day.

Also, does the fact that the bowl (paraphernalia) had marijuana resin mean that they can charge me with something else or not? Basically I am paranoid because we are changing the story. Is there still no chance that I would get locked up?

No one can forecast with any certainty what a judge will do but
I would say that you are in the clear! The Judge will know that
you were in violation and generally he knows the Officers! He
knows that if the Officer did not cite you there was a reason!
So relax

You can not get sentenced at another person's trial. The chances are zero.

Unless your friend tries to use you as a scapegoat, I'd say that it's unlikely your name will even come up.
