If your fired for doing your 8 hours but cannot keep up with "quota" every day, is that unjust and can you collect unemployment? I work from home on piece rate, they do not pay us overtime but expect 9 hours a day + weekends, and I cannot keep up with and have been threatened with being fired, can I collect unemployment? I live in PA

It's not unjust, but you might be able to collect unemployment.

You say you are working at home - are taxes taken out of your paychecks, or are you treated as a contractor and get your full pay and you are responsible for taxes? If you are an employee with taxes taken out of your check, you can probably get unemployment, but it would be unusual under the circumstances you describe, paid on a piece rate, for you to be classified as an employee. If you are a contractor (taxes not taken out) you can't get unemployment.

You will most likely be able to get unemployment.

But that isn't really unjust. If they have a quota and you didn't meet it, then they had every right to fire you.

how was the qouta established ? i mean did anyone try to meet it before ?

I would start looking for new jobs . sounds like a lousy place you are working. quality is what matters.

also consider talking to labor attorney lawyer to learn what you should do to prepare for being fired. know your rights. make sure you do the documenting that you should be doing to make sure that things go smooth should you need to take unemployment and/or future litigation against them. not saying that you will / or will need too but good idea to know your rights/options. also keep looking for new job
