So yeah, I bought an item from a seller who now claims to have lost it or previously sold it without taking the item of the listing... he said he will contact me tomorrow...
What can I do if he doesn't find it?

I paid through Paypal...

I'm not worried about him 'fudging' me or cheating me... he has a very hight rating, 99.8 I last checked... I'm more worried about getting my money back.

He needs to reimburse you. If there is any fudging on his part regarding this, take it up with ebay and pay pal. Don't sweat for now though, its likely a genuine mistake and he'll do the right thing. Did you check his feedback? If hes made any significant number of deals and has good feedback (95%+/-) its not likely that hell rip you off.

he should refund your money a.s.a.p.if he doesnt report it as item not received on ebay,,they will make enquiries and get in contact with pay-pal,,you will get your money back,,,,and in future look at the persons feedback on how much they have and the negitive feedback they have before you bid on a item,,,,dont worry i know what it feels like to be rip off,,there a some(very few) scammers on ebay.....but the rest are very honest people,,dont be put off by 1 scammer

Either he refunds your money through paypal, or you contact paypal and they'll get your money back for you. Find another item to bid on.

Seems like a real seller he would refund you but at the end even if he didn't you can do the claim anyway.
