I read many post about divorce and they all say that we have to wait about 2 years. I also saw some DIY websites that say that you don't even have to go to court and your divorce will be completed. Do they still take same amount of time? Me and my partner agrees to get divorce so is it possible to get divorce quickly. We just don't get along anymore, is this a good reason?

My point is that we can part with happiness instead of sadness or trying to hurt or hate each other. I am sure reality will hit us later as we have been together for 20Plus years. I think it is best instead of living together in misery.

Back date the time you were separated and let it look like its almost two years and file for divorce. You have to beat the system to get what you want. Be creative and think smart to get things done they way you all want them to be if you both want urgent divorce.
Secondly its doesn't matter if you are in court or not . A single signature is enough for divorce even if the other party is unwilling or don't show up. It normal takes 60-90 days for it to be finalized

In the UK you have to be seperated for 2 years before you can divorce, a divorce can be obtained sooner but only if one of you was citing "unreasonable behaviour" or one of you had had an affair you cannot get it sooner just because you don't get along.....

Myself and my husband split on friendly terms we just waited the 2 years and then applied for a divorce through the courts - if you and your hubby have sorted all the finances and there are no issues with children, then you can do the divorce yourself and NOT pay out huge solicitors fee's - its really easy

Im not sure but I really think it depends on where you live. My husband and I were going to divorce (without a fight) and so we werent going to get lawyers and go to court, so I ended up buying the legal documents online and they filled out all the information and all we had to do was wait for the papers in the mail, sign them and take them to the court. Well we didnt make it to the court, we chose therapy instead, but I think thats the fastest way to get a divorce (not going to court) because waiting for a judge and getting lawyers together and all that is what takes so long. A costs a bunch. PLUS if you make more money then her, she can sue you and make you pay for her divorce lawyer. (watch out for that one, a lot of people dont know that)

You are right in wanting an amicable divorce. Make an appointment with a divorce lawyer for a free consultation. He/She will be able to answer these questions for you. Every state is different, so no one here can actually answer this for you. Most lawyers will grant one free consultation. My husband and I also decided to divorce and plan on an amicable one. I believe it's the best way to do so, especially if you've been married to eachother for so long (mine was 25 years) you obviously got along for that long, why not remain friends in the end.

If you are separating and then agreeing on divorce you have to wait 2 yrs before filing. If it would be contested and you are separating it will be five years. You can also file due to abandonment, adultery and unreasonable behaviour. The last three you can file at anytime, it will not take 2 yrs to come through. Hope it helps.

in USA each state is different. in Indiana you can get divorced in 90 days if you are not fighting over anything.. its hard to part and be friends. what most time happens is you part enemy's and later learn to have a friend ship after all the bad has gotten out of the way. good luck

In Canada usually around 18 months usually have to be seperated living in different places of residence for 1yr then you can file for divorce. Check with local family lawyer if nothing is contested they may be able to expedite the procedings.

In Scotland a divorce can take as little as 6 months if both parties are willing.

Mike;

Divorce is never the answer. You don't mention if you have children. After 20 years I think it not presuptious of me to assume there are children. The children need you both. If you are intent upon getting divorced, Please share custody of your children.

The children need both of you, not one. Love them enough to work things out with your wife so that they spend equal amounts of time with both of you.

I have included a few links below that I am sure will help both you and your ex find a way to put aside your petty differences and help you work together for the sake of your child. Studies show that equal time with both parents will make a child more likely to grow up emotionally well adjusted and healthy, and more likely to perform better in school and life.
