It has already been answered why Booker T can use his name. You can't copywrite and prevent someone from using their real name. Booker T's name is Booker Tio Huffman. So Booker T is just his first name with his hs middle initial. Perfectly legal and there is not a damn thing greedy Vince McMahon can do about it. However in response to blackmachismosavagelet about why the Dudley's can't use their ECW name "Dudley" because when they signed with WWE, Bubba who handles their business agreed to let Vince copywrite it for promotional use, with the understanding that the Dudley's could retain usage rights should they depart WWE. At the time there was no competition to WWE and apparently they didn't get that in legal writing. When the Dudleys left for TNA, Vince reneged on that promise. Never trust a McMahon, get it in writing.

The Booker T gimmick was made in WCW and WWE never owned it. The phrase "Can You Dig It, Sucka" was also WCW, so TNA has every right to use it. I'm not sure why WWE wouldn't let Team 3D use The "Dudley" name, because that was an ECW. Plus, it is his real name (Booker Tio Huffman).

Some names are owned by the wrestlers themselves (e.g. Booker T used that name with Harlem Heat in the early 90s in the UWF prior to coming to WCW). Other names are owned by the wrestling company (e.g. The Undertaker, Razor Ramon, and Diesel).

the theme music was different...but i thought the WWE owned the booker t. gimmick and the "can u dig it" catchphrase and the spinorooni since they bought out WCW and became owners of all that was WCW related...but i guess i was wrong.

i m not sure if wwe owns the booker t name

Wrestlers can buy and own rights to their gimmick name, likeness, and characteristics (including catchphrases and theme music). Also, wrestlers can use their real names in other companies (i.e. Andrew Martin aka Test).
The Rock, for example, has permission to use his wrestling name for credits in movies.

Booker T.'s gimmick was owned by WCW not WWE, which when they purchased WCW, they had to use it i guess.
But it originated back in the old WCW days with his older brother Stevie Ray ... "NOW CAN U DIG THAT????"
