My daughter's father currently has a support order where he is to pay $60 a week + $120 a month towards arrears which is nearing $11K. He agreed to this order in 2003 at a time where he didn't have a wage attachable job but was working under the table. Even though he agreed to this, he didn't pay a dime as you can see from the arrears. He finally obtained an on the books job this year and he's income was attached, but I still wasn't getting was ordered. When I found out he was working, I could have gone back to court 2 see if I could get an increase, but I wasn't interested and just left well enough alone. I just wanted him to pay what he said he could afford. Now he is taking me to court requesting a decrease and we are scheduled 2 go this wk. I want 2 know even if he is requesting a decrease and if he has proof of income that shows he could afford more than what was ordered, can they increase it? Also, I have daycare expenses that total $500 a mth. Can they order him 2 pay half?

It's just amazing he's requesting a decrease and not paying anything at all. And who and what can a person support on $60 a week. I have been supporting my daughter for the past 4 years without, but it will be a help to her.

They definitely can increase it. Show that he has not made payments. That will also work against him. Yes, he should be paying half of the daycare expenses. Good luck.

I know exactly what your saying. He will be ordered to help you pay half of the daycare its his duty too. The judge will look at his income and yours. Then will determine if he will decrease or not. From the way the arrears look I don't think the judge will decrease anything. In that case he would up the payment and have him help you out more. Don't agree to anything. make him pay. He is just as responsible for your daughter as you are.
