I talked this question with my friends on interracialmatch.com.In our opinion, if they society is justice, it should be the same.

No, white will get less time than the black person would and if they tried punishing the black person there would be riots and he'd be let off
No one, no matter what color is given the punishment they deserve now days... I like to be nice but criminals need to be punished

they probably wouldn't be prosecuted for the same thing. Say for instance they beat someone up badly. the black guy would be charged with attempted murder, and the white guy would be charged with assault.
