Distance. My divorce was in New York. I live in California. Everything was done via the internet/faxing and snail mail. However we had been seperated for a considerable amount of time and everything had been worked out PRIOR to taking it to court. Everything from child support to visitations, to separation of property. During the legal separation we did the "arguing" back and forth and worked it all out.

However if you mean "how do I get a divorce without the other person knowing". You can't. they have the legal right to know whether they would argue about it or not. You don't get to avoid your responsiblities just because you want to end your marriage.

By "not physically present", do you mean this other person is not around, which means the divorce is possible or that you do not want this person to know anything about the divorce, thus not being physically present in divorce court cause they wont know about it which in that case the divorce is impossible

I live in Va and did just that. I went to a lawyer filled out the petition. Got it notorized. It was mailed to my ex overnight, he got his notorized. My lawyer went before the judge and the divorce was granted. I had already gone through the courts prior to the divorce for custody and child support. It was pretty easy.

Use power of attorney, but get someone who you trust will do exactly what you would do if you were there.
