america hasn't really decided what immigration policy it wants.
some folk fervently believe that we should welcome anyone who can get here, no matter how many. One advocate of this that I talked with wasn't even sure she'd limit criminals -- said that way too many 'crimes' in foreign countries were simply people rebelling against stupid laws.
other folk want to strictly limit immigration to people with a reasonable education [but he didn't define that] and who work in tasks where we have a proven shortage. They'd issue national id cards to all citizens and legal residents and prohibit any employment whatever to anyone who doesn't have one.
i can't begin to figure out how to get the two of these people to actually talk to each other on the subject -- both think the other is completely crazy.

To let them in and freely roam anywhere. The Bush administration likes the Mexicans because they support small business which likes cheap labor. They view this as a convenient way to propagate business. They blatantly ignore the Constitution and already set law by making loop-wholes like guest worker programs and amnesty that differs state to state. In reality, the policy is more of an economic issue than a legal one. As far as enforcement goes, there has always been the INS, but now the Homeland Security Dept. has the ICE but they only go after people who look like terrorist (Muslims) while largely ignoring the other illegals. Here in NYC, every morning there is like 30 illegal Mexicans sitting on the street corner waiting for small business (construction, landscape, etc.) to pick them up for a day's work of cheap under the table pay. They hang out Starbucks near my place and the cops are there in the morning to to get coffee but just leave them alone. They are not even scared - they walk around because enforcement turns the other cheek. SO, to answer your question, the law states anyone without legally gained citizenship is illegal; and a variety of States have variations on this; but realistically, nothing much is done. A law is only as good as it is enforced. If a tree falls in a forest and no one is there to see or hear it did it really fall? This is the sentiment behind most of our nation's law.

Well it's BS that there be amnesty when there are thousands of people who have come here LEGALLY, paid thousands of $$$ to lawyers and immigration to have to wait YEARS for their residency, when others come here ILLEGALLY and they get their papers for free... that's BS... but we can't just close the borders because believe it or not, many Americans are lazy and they don't like doing hard labor, they like others to do it for them, so unless people on welfare are willing to get off their butts and go pick up fruits, and cut grass, and do ALLLLL the other hard labor that Illegal immigrants are doing, then i guess we need them here... but not for free... how about setting up a plan where they start paying taxes with the nice IRS provided tax payer id number, after 3 yrs of paying taxes, and not getting into any trouble with the law, they can apply for a temporary permanent residency, after 2 more yrs, if everything is well, then permanent residency is granted... with or without the ability of naturalization (becoming a US Citizen).... that's up to Congress to decide... as for the people who came here legally, and paid money to immigration, they should be granted papers 1st, it's only fair... and they should too have to pay taxes... if US citizens have to, everyone should too... And those who fail an FBI background check and have been in jail and are pure trouble... all them need to be deported... there's no room for trouble-makers in this country... and also we need to secure the borders, if it means paying legal wages to people to build it, then freaking do it.... the Chinese built a wall like 2000 yrs ago and it's STILL standing today, why is it that Americans can't do it????

The government puts it's ineffectual finger in the dike in an attempt to hold back the tide.
In time, the dike collapses and immigrants outnumber the indigenous population.
It is the same most industrialized western countries.

im actually debating this topic in school.... but we dont really have a specific policy but it does need to be enforced because we have so many illegal immigrants. if u want more info, just ask! i have info to support the PRO side of enforcing the policy, and the CON side of it !

We want more people from Iceland, from Canada, from Australia (rare immigration countries)...
We want less people from Mexico, China (massive immigration countries)...
Right now almost every immigrants is hispanic, I do not call this succesful diversity

I think we need to have laws that spell out the proper way to immigate legally and then we need to clearly spell those laws out. These laws would be decided by society as a whole.
Those people who then broke those laws would be punished and deported all without fear of the system being called "racist" That is how it should work.
