It is Criminal and it is both a State and Federal offense. If they commit other Crimes such as Identity Theft Fraud, to just be in possession of someone else's social security number is Twenty years. There is an Ethical and Right way to do anything.

Those Congresspersons and Senators are equally responsible for allowing them to stay here and are not upholding their Oaths of Office in trying to sustain Amnesty. Every last one trying to stop the Building of the Walls For Homeland Security on both North and South Borders needs to be Impeached. Border Security Officers are being killed and unjustly put in jail for doing their jobs. It is the only way to sustain Sovereignty and Freedom

I don't know if it is criminal or civil but there are laws about being in the country without proper documentation. There are ways to live in this country legally and those that are here illegally are most certainly breaking the law.
If you ask me I believe that when they are caught and deported their own country to which they are deported to has a responsibility to prosecute them also, as all we do it deport them it's a slap on the wrist and then they are just back crossing the border two days later. It is a joke to them, I have spoken with some border patrol guys here in AZ and when they catch these illegals and send them back; the illegals just say "hey I'll see you tommorow." What is that...there is no repercusions for them that's why immigration is considered a joke in this country, cause that person might not get caught the next day either then they are here and who knows for how long before they may be caught again.

Yes they are committing a crime if they are illegal aliens. The shear term "illegal" states that they have entered the country and remain in the country unlawfully. Also the fact that they pay no taxes, but yet take advantage of social programs like welfare and medicaid. Not paying any taxes on income for work that is performed in the U.S. is illegal. There are several who resort to obtaining false SSN's to obtain more benefits, which is identity fraud and theft, which is illegal.

It depends on how they entered the country. If they entered legally, for example on a tourist visa, and didn't leave when that visa expired then they have committed a civil violation. If they sneaked across the border, not going through immigration, then it's a felony, however it's one that's not generally prosecuted.
