He is very happy and full of life. Get's all A's in school and is emotionally stable. He tells me daily how much he loves me and thinks of my partner of 21 years as his daddy. Yet, we can't adopt him because we are gay. Is that fair?

I think it's very disturbing that people in this country, and in this day and age, are still being treated differently because of their sexual orientation. If someone is heterosexual, their sexuality never comes into question; even if they are promiscuous. Why should it be different with homosexual couples? I think all couples, same-sex or otherwise, should have the same rights across the board.

Unfortunately, most of the states in the union forbid same-sex couples petitioning for adoption. There are some that do allow it, however, and it may behoove you to move and become a resident of a state that is more tolerant. There is actually a list of states and their tolerance on wikipedia that may help you.

Good luck to you and your family. That little boy is very lucky to have you both.

BTW - homosexuality is NOT a mental disorder any more than heterosexuality is one. What IS a mental disorder is homophobia and I've seen a couple of indications of that disorder in the answers to this question.

No it's not. I think the adoption standards are too high. Even Chinese adoption agencies say that they will not let gay people adopt or single women or fat people. A lot of people have tried to adopt their family members children but have been denied. Which in most cases means that the child is not covered under any ones insurance. So none of this is for the child's good I think it's all just for the money.

Life isn't fair, an adoption is a contract, get a laywer, get a contract... Also don't try to adopt as a Gay couple, adopt as he is your nephew. Then it is not legal to consider your lifestyle since they can't ask all the snoopy questions. Get a LAWYER and go after the nephew... you are blood relation and should have priority and anti gay is illegal anyway..... if it isn't it should be. You go guy and fight for what is yours....

If that is the ONLY reason why you can't adopt him then NO, it's not fair. But as long as you are the custodial guardian of the child the who needs the extra validation of adoption?

no thats no fair because if your sister wanted you to raise him and adopt him then you have every right to. but people these days dont treat people the same way. my half brother has the a problem like this.

That's not fair at all. Your sexual orientation should have nothing to do with it.
Well, there is a good side to the situation-that little boy is going to grow up to be much more open-minded about homosexual people than most.

no it sure doesnt seem fair, but then who cares, right? he's yours in spirit and in heart and that's what really matters here isnt it? adoption is a legal state so, i guess from the practical side like for taxes and such it probably would be beneficial, but as the boys aunt and custodial care provider, you can probably qualify that on your taxes anyways.

i think your sister would be proud to know that her boy is in such capable hands. keep your chin up.

Slender V, somebody has given you the wrong scoop. You can adopt your nephew. It does not matter what your sexual orientation is.

GET A LAWYER NOW and sue the b@stards who are stopping you from adopting your nephew.

No it is NOT fair , I'm a heterosexual male and I see no reason why two people in love regardless of any sexual persuasion cannot raise a healthy happy little boy


May do a better job than alot of straight people actually

I have my views on gay marriages. but i think that is totally unfair. you can't adopt him because your gay.. why do they think gays cant take care of children and love them as much??? that is ridiculous. i hope the best for you. these laws need to change
