You pay for the test, not the "pass".

If your state requires the emmission test to be passed before you can register it, you need to get that fixed, first.

You will likely have to pass the emissions test before registering. Yes they can charge the fee even if you don't pass. Here in Texas you have 15 days to correct the problem and the check that problem free. After 15 days you pay again.

Why would you want to drive a car that has an emissions problem. That only contributes to the pollution.

You cannot register a vehicle until it has passed inspection.

As for state specific questions if you edit or comment and let people know which state it's in, they might be able to help you.

In many states due to new emmisions regulations, you have to get the repairs done. Can't just toss an extra 20 at someone and have them put a new sticker on. In many states those days are gone.

If he didn't charge you then he was probably doing you a favor since the vehicle failed.

If you're not an evironmentally friendly person, there are some auto service shops in your area that will pass your car with $200-$300 throwing at them, a quick way to get it registered.

If it didn't pass, you can't get it registered until you get it fixed. and yes, the $25 is for the test, not a guarantee you will pass.
