Go to the reference section of your local library and find the IRC Code. This is the International Residential Code,and virtually all local code people use it as their standard. It should say that residential railings need to be a mininum of 36" and commercial railings a mininum of 42". But check the code because they get re-written and you don't want to fail an inspection.

Go with 42 inches. Regardless of the code that might let you get away with a 36 inch minimum, that extra 6 inches will prevent you from ever getting enough top-heavy leverage to tumble over the rail if you lean against it.
