If a Colonel in the Army is put under arrest for murder/attempted murder (in another state) - does he stand trial where the crimes are committed, or does he get shipped back to his post to stand a military trial? (I am writing a story - need it to be believeable)

Actually, it all depends on the Prosecutor or the DA if it happened off base. They could either try the case downtown, or hand jurisdiction over to the base. If it happened on base, then the base would definitely have jurisdiction.

Mac is correct, if it happens on base the affairs of the trial are handled entirely by the military. If it happens off base, the local civilian judicial system and the first shirt/legal office will normally come to an agreement as to the proper method of going through the judicial system. It could go either way at that point.

If the murder was committed on post the military would most likely try the case. If the murder was committed "out in town" then the state where the murder occurred would try the case.

There was a case recently where a reservist was recalled to the army so that he could be put on trial for murder. Wish I could remember a name or something so you could google it for more info.

if the crime was committed against a civilian, it should be tried in a civil (or criminal) court where the crime was committed--that court has jurisdiction. If against a military person, and on a military base, it should be in a military court.

He is trried in the juridiction where the crime was committed.
